These Terms and Conditions set out the basis on which Rubbish Clearance Wandsworth provides rubbish clearance, waste collection and related services. By making a booking, accepting a quotation, or allowing our operatives to carry out work at your premises, you agree to be bound by these Terms and Conditions.

If you do not agree with any part of these Terms and Conditions, you should not use our services. These terms apply to domestic and commercial customers unless expressly stated otherwise in a written agreement signed on our behalf.

1. Definitions

In these Terms and Conditions, the following words have the meanings set out below:

Customer means the individual, business, company, or organisation requesting the services.

Services means rubbish clearance, waste collection, loading, transportation, and related services provided by Rubbish Clearance Wandsworth.

Waste means any items, materials, goods, or substances that the Customer asks us to remove and that we agree to collect.

Premises means the property or location where the Services are to be performed.

Agreement means the contract between Rubbish Clearance Wandsworth and the Customer incorporating these Terms and Conditions and any written quotation or confirmation.

2. Scope of Services

Rubbish Clearance Wandsworth provides waste collection and clearance services including removal of household waste, garden waste, bulky items, and certain commercial waste, subject to applicable regulations and limitations set out in these terms.

The exact scope of work for each booking will be set out in our quotation or confirmation, which may be given in writing, verbally over the phone, or by electronic messaging. The Services are limited to those items and areas agreed at the time of booking or as amended and agreed on site before work starts.

3. Booking Process

Customers may request a booking by phone, email, or other accepted contact methods. We may ask for information about the type and estimated volume or weight of waste, access details, parking arrangements, and any special requirements.

Any quotation provided before our arrival is based on the information supplied by the Customer and may be subject to change following an on-site assessment. We reserve the right to revise the price or refuse to carry out the work if the actual waste type, volume, access, or conditions differ significantly from the description provided.

A booking is only confirmed once we have accepted it and provided a collection date or time window. We will use reasonable efforts to attend within agreed times, but timing is not guaranteed and may be affected by traffic, weather, access, or operational issues.

4. Access and Parking

The Customer is responsible for ensuring sufficient and safe access to the Premises for our operatives and vehicle. This includes arranging parking permits or permissions where required and making sure that any gates, communal areas, or internal routes are available and safe to use.

If suitable parking is not available, or access is restricted or unsafe, we may charge waiting time, apply additional charges, or cancel the booking. If we are unable to complete the Services due to access or parking issues outside our control, any call-out fee or minimum charge may still be payable.

5. Waste Types and Restrictions

We collect most non-hazardous household and commercial waste, subject to capacity and legal restrictions. Certain items are restricted or may incur additional charges, including but not limited to electrical appliances, mattresses, tyres, construction waste, plasterboard, and heavy materials.

We do not collect hazardous or special waste unless expressly agreed in writing and subject to appropriate licensing and charges. Hazardous waste includes, but is not limited to, asbestos, chemicals, solvents, oils, clinical or medical waste, gas bottles, explosives, and radioactive materials.

The Customer must inform us before or at the time of booking about any materials that may be hazardous or require special handling. If we discover hazardous or unsuitable waste on arrival or during loading, we may refuse to collect it, apply additional charges, or terminate the Services. Any waste we reasonably believe to be unsafe to handle or transport will not be removed.

6. Customer Obligations

The Customer confirms that they are the owner of the waste or have the owner’s authority to arrange its removal. The Customer warrants that the waste to be removed belongs to them and that its removal will not breach any law, lease, or other agreement.

The Customer agrees to:

Provide accurate information about the waste, including type, approximate volume, and any special handling requirements.

Ensure safe access to the Premises and to the waste, including adequate lighting and clear routes.

Keep children, pets, and third parties away from the working area while our operatives are on site.

Not request removal of any items they are not legally entitled to dispose of.

7. Pricing and Quotations

Prices are generally based on the volume and type of waste, labour involved, access difficulties, and any disposal charges, such as landfill, recycling or specialist handling fees. We may provide an estimated price range before the visit and confirm the final price once we assess the load on site.

All quotations are exclusive of VAT unless otherwise stated. If VAT is applicable, it will be added at the prevailing rate. We reserve the right to amend any quotation if the information provided by the Customer was inaccurate or if additional work or waste is requested.

Unless otherwise agreed, a minimum charge applies to each visit. Charges may also be incurred for additional labour where waste is not ready for collection, is located on higher floors without lift access, or requires dismantling or extra handling.

8. Payments and Invoicing

Payment is due on completion of the Services on the day of collection, unless otherwise agreed in writing. We accept payment by cash, bank card, or other methods as notified. Commercial customers may request invoicing terms, subject to credit checks and our approval.

Where credit terms are agreed, invoices are payable within the period stated on the invoice. If no period is specified, payment is due within 14 days of the invoice date. We reserve the right to charge interest and reasonable recovery costs on overdue invoices in accordance with applicable UK law.

Ownership of any waste does not revert to the Customer once it has been loaded onto our vehicle, even if payment has not yet been made. However, non-payment may result in legal action to recover outstanding sums.

9. Cancellations and Rearrangements

The Customer may cancel or rearrange a booking by contacting us during our normal office hours. We ask for at least 24 hours notice before the scheduled arrival time to cancel or amend a booking without charge.

If the Customer cancels with less than 24 hours notice, or fails to provide access when we arrive, we may charge a cancellation fee or call-out charge to cover our costs. Same-day cancellations may be charged at up to the minimum load rate or any agreed call-out fee.

We reserve the right to cancel or reschedule a booking if we are unable to attend due to circumstances beyond our reasonable control, including vehicle breakdown, severe weather, staff illness, or safety concerns. In such cases we will endeavour to rearrange as soon as reasonably possible and any prepayments for unperformed Services will be refunded or applied to the rearranged booking.

10. Service Performance and Timeframes

We will use reasonable skill and care in providing the Services and will endeavour to arrive within the agreed timeframe or time window. However, time is not of the essence and we shall not be liable for minor delays caused by events beyond our control.

If there is a significant delay or we are unable to attend, we will inform the Customer as soon as reasonably practicable and offer a new appointment. Our liability for any delay is limited to the charges for the affected Services and we are not responsible for consequential losses such as lost earnings, tenant issues, or penalties from third parties.

11. Damage and Liability

We will take reasonable care when carrying out the Services. However, the Customer acknowledges that minor scuffs or marks may occur where large or heavy items are removed from tight spaces or through narrow access routes.

We shall not be liable for:

Any pre-existing damage or defect at the Premises or to items handled.

Damage caused by poor or unsafe structural conditions, including weak floors, staircases, or walls.

Damage where the Customer has insisted on removal through a route that we have indicated is unsuitable or risky.

Any loss of profit, loss of business, or indirect or consequential loss arising from the Services or any delay or failure to perform.

Our total liability to the Customer for any loss or damage arising out of or in connection with the Agreement, whether in contract, tort, or otherwise, shall not exceed the price paid or payable for the Services giving rise to the claim, except where liability cannot be limited by law.

12. Items Not Intended for Removal

The Customer must clearly separate items that are not intended for removal from items that are to be collected. We cannot accept liability for items removed in error where they were not clearly identified or segregated, or where the Customer or their representative was not present during loading.

If an item is removed in error, the Customer should notify us as soon as reasonably possible. Where practicable, we will attempt to recover it if it has not yet been processed or disposed of. However, we cannot guarantee retrieval and are not liable for any associated loss beyond the limits set out in these terms.

13. Compliance with Waste Regulations

Rubbish Clearance Wandsworth operates in accordance with applicable UK waste legislation and regulations. We will transport and dispose of waste only at authorised facilities and will take reasonable steps to ensure that waste is handled lawfully once it leaves the Premises.

Where required, we will issue a waste transfer note or equivalent documentation. The Customer agrees to provide any information reasonably requested to complete such documentation, including the type of waste and its origin.

The Customer acknowledges their duty of care under UK waste regulations and agrees not to request or encourage any unlawful disposal, fly-tipping, or handling of waste. We reserve the right to refuse any instruction that would breach relevant laws or our regulatory obligations.

14. Environmental Practices

We aim to reduce the amount of waste sent to landfill by separating and recycling materials where practicable. However, we do not guarantee that any particular item will be recycled or reused. The method of processing or disposal will depend on the nature of the waste, facility availability, and regulatory requirements.

15. Complaints and Dispute Resolution

If you are dissatisfied with any aspect of our Services, you should contact us as soon as possible with details of the issue. We will investigate and seek to resolve complaints promptly and fairly.

Where a dispute cannot be resolved directly, either party may consider using negotiation or other forms of dispute resolution before commencing formal legal proceedings. This does not affect either party’s right to bring a claim in the courts.

16. Data Protection and Privacy

We collect and process personal data such as names, contact details, addresses, and payment information in order to provide and manage our Services. We will handle personal data in accordance with applicable UK data protection laws and use it only for legitimate business purposes, including bookings, invoicing, and service improvement.

We may retain records of work carried out, including written notes and photographs, to evidence the Services, address complaints, and comply with legal obligations.

17. Amendments to These Terms

We may update or amend these Terms and Conditions from time to time to reflect changes in law, regulation, or our business practices. The latest version will apply to any new booking made after the date on which the updated terms come into effect.

For ongoing or long-term arrangements, we will notify the Customer of material changes where reasonably practicable. Continued use of our Services after such notification will constitute acceptance of the updated terms.

18. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of our Services.

19. Severability

If any provision of these Terms and Conditions is held by a court or competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms and Conditions, together with any written quotation or confirmation we provide, constitute the entire agreement between Rubbish Clearance Wandsworth and the Customer in relation to the Services. They supersede any prior understandings or agreements, whether written or oral, relating to the same subject matter.

No variation of these Terms and Conditions will be effective unless agreed in writing by an authorised representative of Rubbish Clearance Wandsworth.
